Please read our Jeff Palicki Photography General Terms and Conditions (“Terms and Conditions”) carefully. These Terms and Conditions govern your access, use and orders placed at www.jeffpalickiphotography.com, its mobile sites and applications (collectively, the “Site”). By placing an order with Jeff Palicki Photography, you agree to be unconditionally bound by these Terms and Conditions in the version valid at the time of ordering.
Orders and authorization
By placing an order on this Site, you represent and warrant that you have all the necessary permissions, rights and authority to place the order and you authorize Jeff Palicki Photography to produce the Products on your behalf. You grant Jeff Palicki Photography the right to copy, modify, distribute, use, create derivative works of and vectorize any content you have uploaded for the purpose of fulfilling your order and/or marketing products or services to you.
Payment
Payment is due in full at the time you place your order. Work begins as soon as your payment, order details and photos have been received.
Custom work and no refunds
Every graphic is custom work, designed and produced specifically for you and your order. Because production begins as soon as your order, details and photos are received, all sales are final and all payments are non-refundable. If there is an error on our part, we will make it right through revisions rather than a refund.
Revisions
Every order includes one free round of minor alterations. Additional rounds of revisions typically run $10–$20 depending on the work involved.
Delivery and turnaround
Standard delivery is one business day after we have received your photos and order details. Stated turnaround times are estimates and are not guaranteed, and may be affected by the completeness of the information you provide.
Branding
All graphics are delivered with a Jeff Palicki Photography logo/branding unless a $50 removal fee is paid at the time of ordering.
Your content and rights
Moreover, you represent and warrant that you have sufficient rights to permit Jeff Palicki Photography to copy, distribute, use, modify, create derivative works of and vectorize any uploaded content for the purpose of fulfilling your order and/or marketing products or services to you.
Image rights and licensing are your responsibility
It is solely your responsibility to obtain the advice of an attorney regarding whether a Design(s) and/or image(s) is legally available for your particular use and does not infringe the rights of another party. You are solely responsible for determining whether a license or other additional rights are required in connection with the intended use of your Design(s) and/or image(s) for obtaining such additional rights.
You are solely responsible for determining whether a license or other additional rights are required in connection with any/all images that you upload and/or provide to jeffpalickiphotography.com.
Chargebacks
Because all sales are final and all custom work is non-refundable, initiating a chargeback or payment dispute on a completed or in-progress custom order is a breach of these Terms and Conditions.
Limitation of liability
To the fullest extent permitted by law, Jeff Palicki Photography’s total liability arising out of or relating to your order or these Terms and Conditions will not exceed the amount you paid for the order in question. Jeff Palicki Photography is not liable for any indirect, incidental or consequential damages.
Changes to these Terms
Jeff Palicki Photography may update these Terms and Conditions from time to time. The version in effect at the time you place your order governs that order.
